By using BID AND BUY’ services, you accept the following Terms and Conditions, as well as the manner in which BID AND BUY operates. These Terms & Conditions constitute the entire agreement between BID AND BUY and You, and supersede and replace all prior commitments, undertakings or representations, whether written or oral, between You and BID AND BUY with respect of Your use of BID AND BUY.
Information on www.BIDANDBUYINDIA.COM, such as the "How it Works" or "Help" section, are only recommendations and are not intended as guidelines. BID AND BUY is not liable or responsible for the actions of users or other individuals who have read or been informed of such information or other written material.
BID AND BUY reserves the right to change these Terms & Conditions at any time without notice to You.
By accepting the Terms & Conditions and/or registering with BID AND BUY, You confirm that You are eligible (as specified in the "Eligibility" section) to use BID AND BUY.
If You do not agree to the Terms & Conditions, please do not use BID AND BUY.
If You access and use any service from BID AND BUY, You agree to and are bound by these Terms & Conditions.
By accepting the Terms & Conditions and/or registering on BID AND BUY, You confirm that You are at least 18 years of age and at least age of majority subject to the laws of the state, city or other legal entity; therefore You can engage in a binding contract. By using BID AND BUY, You warrant that You have the right, authority, and capacity to enter into this agreement and to abide by all of the Terms & Conditions. By registering on BID AND BUY, the user declares that they are legally capable of entering into binding contracts. BID AND BUY employees and their family members may not, under any circumstances, participate in BID AND BUY auctions.
BID AND BUY products and services are offered exclusively to private users and not to commercial or semi-commercial retailers.
BID AND BUY reserves the right, at its sole discretion, to deactivate any user’s account based on suspicion of the use of such software.
You hereby declare and warrant that You are at least 18 years of age and at least age of majority subject to the laws of the state, city or other legal entity, therefore You can engage in a binding contract; You reside in a jurisdiction in which BID AND BUY operates; Your user account may be used only by You and not by anyone else. All information that you provide us during the term of validity of this agreement, is true, complete, and correct, and that you shall immediately notify us of any change of such information.
As part of the registration process you will have to choose your username and password for your login to BID AND BUY.
During the registration process, you must choose a username, which must not in any way be offensive, indecent, insulting or intended to deceive or mislead other users or persons, whether intentionally or unintentionally.
Nor may a user name advertise for or promote any other websites or services, provide links to or for other websites.
Please note that BID AND BUY reserves the right to change usernames, for whatever reason, and is the final arbiter on policy.
BID AND BUY will never ask for Your password apart from login. You are solely responsible for Your user account password and its preservation. We suggest that you not provide your password to anyone, including BID AND BUY’ employees. User accounts are non-transferable.
We are not responsible for any abuse or misuse of your account by third parties due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party.
Users can place bids by manually clicking the relevant bid button or using the automatic AutoBid function.
AutoBid lets users bid on an auction even when they are not online or logged in. The AutoBid automatically places bids according to the user’s instructions. For more information on AutoBid, visit the "FAQs" section.
Bids are purchased in advance in the form of "Bid Packs". BID AND BUY reserves the right to offer different size Bid Packs at different times; also, BID AND BUY could offer free bids at its sole discretion. All placed bids and free bids are non-refundable. All unused credits are non refundable and non transferable.
With each bid placed, the price of the item on which the user is bidding increases by a small preset amount (10 paisa INR to 100 RS INR). Each new bid resets the remaining time for an auction up to the amount specified for the Auction Type (usually 10, 20, 30, 50, and 60 seconds or up to 10 Minutes as specified for that particular auction).
An auction closes when no more bids are received by BID AND BUY’ servers. The countdown time is indicated for each auction. Due to the time it takes for bids to reach BID AND BUY’ servers, and in order to allow all users the same opportunity to bid regardless of geographic location, BID AND BUY’ servers will wait for an additional 5 seconds for any placed bids to reach BID AND BUY servers before closing the auction.
The user who was the last to place a bid wins the auction and can purchase the product.
Bids become valid when they are entered in the BID AND BUY database and registered in BID AND BUY’ system. BID AND BUY is not responsible for disruptions in the user’s connection and errors that may occur as a result of this. This includes, but is not limited to, incorrect countdown of the remaining time, outdated information on bidders, and bids.
Once an auction is closed, the winner, goes to My Account for information on the total price, including shipping costs, and payment options. Once the auction is closed, the winner has 15 days to pay the total price of the product, by following the steps indicated on the website. After confirming the win and paying the amount due, the winner will receive a confirmation e-mail. BID AND BUY will ship the product within 21 days after payment confirmation is received. The buyer must also provide an accurate delivery address on the account, before BID AND BUY can ship the product. After BID AND BUY has shipped the product, it will take a few days for it to reach the buyer.
If an auction win has not been confirmed and paid within 15 days, the order will be void and cancelled, spent bids will not be refunded.
Unless otherwise specified, delivery will be made from our supplier’s warehouse to the registered address provided by the User.
As BID AND BUY works with trusted delivery partners to ensure the best possible service and widest reach, all delivery estimates are for information only and do not constitute binding agreements. Obvious damage to the item or packaging during transit should be reported to the carrier by the winning user, if the item is damaged it should be refused, not signed for. If you wish to claim for concealed defects or damage after signing for an item, you must inform us about the damaged or faulty goods within 3 days of receipt. BID AND BUY cannot accept responsibility for damaged or faulty goods once 3 days have lapsed. In all cases you must inspect your item either at the point of or immediately after delivery. Failure to raise a query with BID AND BUY, concerning a damaged or incorrect item within 3 days of delivery constitutes acceptance of the item as is. BID AND BUY does not accept liability for damage or failure of products due to neglect or misuse by the recipient. In the event that BID AND BUY’s delivery partners are not able to deliver the item within a reasonable time, BID AND BUY shall be entitled to offer the winning User a substitute item with comparable or better features, or to set aside the contract through recission and offer a refund of any payments received for the auction item. This does not affect the User’s statutory rights.
The product will be delivered to the address specified by the user. All technical service and product support matters must be taken up directly with the manufacturer according to their terms. In case of cancellation of an order, only the purchase price will be refunded. So, shipping costs will never be refunded. This policy applies both to auctions and Buy Now option.
TERMINATION BY YOU :
You may close your account at any time by sending us notification of your intention.
TERMINATION BY BID AND BUY :
BID AND BUY reserves the right to temporarily or permanently terminate Your account at its sole discretion if it determines You have violated these Terms & Conditions, any laws, or the rights of our other users or other third parties. Examples of unauthorized usage include the use of unauthorized third-party bidding or bid tracking software, the creation of multiple accounts by the same individual, or if BID AND BUY suspects fraudulent account activity or behavior.
You agree that if BID AND BUY, in good faith and in its sole discretion, determines that You have breached these Terms & Conditions, BID AND BUY may withhold, cancel or otherwise retain any and all of Your pending deliveries and/or refunds for bids.
Claims for damages by the User against BID AND BUY, its legal representatives, employees or parties who assist in performance are not permitted. In particular, BID AND BUY shall not be liable for faulty operation of the phone or computer hardware/software during bid submission and for incorrect/slow transmission of bidding data by phone/ISP. Should such an event occur, the User shall have no legal rights over the item. User expressly agrees that use of BID AND BUY is at user’s sole risk. BID AND BUY does not guarantee any results that may be obtained from the use of the website. BID AND BUY cannot guarantee continuous access to the service. While we will use all reasonable endeavours to keep an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services. In the event that an auction has closed irregularly, Users will be refunded the bids spent for the item and the auction will be resumed at a later time. BID AND BUY will do its best to notify the User that the auction has closed irregularly as soon as possible. After a technical error, BID AND BUY has the right to restart all auctions from the beginning, once the problem has been rectified. AutoBids may close before the Users wish them to for technical errors. Anyway, BID AND BUY will do its best to restore the users’ AutoBids, which is, however, not guaranteed.
These Terms & Conditions shall be governed and construed in accordance with the laws of India. Furthermore, these Terms & Conditions shall exclude application of the UN Convention on the International Sale of Goods.
